Description: Boston, MA - Retired Sandwich Police Officer Awarded $225,000 for Emotional Distress

Timothy Kane, a retired police officer, sued the Town of Sandwich, Massachusetts on a civil rights violation theory under the Uniformed Services Employment and Reemployment Rights Act and retaliation theories claiming that he was passed over for promotions because of his military service.

Kane filed the suit around the same time the town launched disciplinary proceedings against him for allegedly providing false information about his rank in the U.S. Air Force Reserve. The town pays officers in active military duty the difference between their military pay and what they would have earned from the town. Military rank affects that rate of pay.

Kane was deployed to Iraq in May 2011.

Defendant denied wrongdoing.

Outcome: Plaintiff's verdict for $225,000.00.
