Case Style: Kimberly VanSlembrouck v. Dr. Andrew Helperin
Case Number:
Judge: Rudy Nichols
Court: Circuit Court, Oakland County, Michigan
Plaintiff's Attorney: Geoffrey Fieger
Defendant's Attorney:
Description: Kimberly VanSlembrouck, individually and as next friend of Markell VanSlembrouck, a minor, sued Dr. Andrew Helperin on a medical negligence (medical malpractice) theory claiming that her child suffered brain damage and a broken clavicle and is a quadriplegic, requiring around-the-clock care. Plaintiff claimed that Dr. Helperin should have preformed a C-section to deliver her child rather and attempt a vaginal delivery.
Defendant denied wrongdoing and claimed that Markell's problems were genetic in nature and not the result of substandard care.
Outcome: Plaintiffs' verdict for $130 million.
