Description: Seattle, Washington personal injury lawyers represented the PLaintiffs who sued the Defendant on product liability, negligence and failure to warn theories.

The Plaintiffs, five students, two parents and employees, claimed that they were injured and/or damages as a direct result of being exposed to PBCs manufactured and sold by Monsanto. The Plaintiffs were students and their parents at Sky VAlleyEducation Center in Monroe, Washington, where polychlorinated biphenyls (PCBs) were included in light fixtures that leaked the chemical.

The Plaintiffs claimed to have developed neurological, endocrine system and other health concerns from exposure to PCBs 7 to 18 years ago.

Monsanto quit manufacturing PCBs in 1977.

Outcome: Plaintiffs' verdict for $73 million in actual damages and $857 million in punitive damages.

Comments: The U.S. Supreme Court has said that punitive damages should generally be capped at nine times compensatory damages, because larger awards would violate defendants' due process rights.
