The City of Portage des Sioux, Missouri counterclaimed against Klaus Lambert and Constance Alt on an abuse of process theory claiming that they filed numerous lawsuits to prevent the City from making them clean up their property. Plaintiff claimed that Defendants would dismiss the lawsuits that they filed before having to prove what they were alleging.
The City claimed that the property owned by Lambert and Alt was in a state of disrepair and was unsafe.
