Kim Davis, the former county clerk of Rowan County, Kentucky refused to issue marriage licenses to two same sex couples.

Davis asserted qualified immunity as a defense against the Plaintiffs' claims.

Davis, a Republican, lost her bid for reelection in 2018. The Democrat Elwood Caudill Jr is now the county clerk.

Outcome: Judgment in favor of Plaintiffs on the basis that Davis " “cannot use her own constitutional rights as a shield to violate the constitutional rights of others while performing her duties as an elected official." Relying on the Obergefell v. Hodges decision by the Supreme Court in 2015.
