However, the Stipulation states that the parties agree "that all Complaints, Third-Party actions, Counterclaims and Cross-claims be dismissed with prejudice in their entirety (with each party to bear their own costs)." Id. Accordingly, Plaintiff's action, including all claims and counterclaims against all parties are DISMISSED WITH PREJUDICE under Federal Rule of Civil Procedure 41(a)(2), with each party to bear their owns costs.
