Description: Chicago, Illinois bank theft charge criminal defense lawyer represented Defendant, Rickie Foy, 38, of Chicago, was charged with joining several others in attempting to break into a Bank of America ATM located in a grocery store parking lot at 620 W. 63rd St. in the city’s Englewood neighborhood. Over the course of approximately eight minutes, Foy and the others used various tools to try to gain access to the machine and steal cash, but they were unsuccessful. Chicago Police officers arrived at the scene and arrested Foy and two others after a foot chase.

The conviction is punishable by up to five years in federal prison.

The government is represented by Assistant U.S. Attorneys Ramon Villalpando and Matthew Madden.

Outcome: MINUTE entry before the Honorable Thomas M. Durkin: as to Rickie Foy. Hearing on the bench trial verdict held by video on 2/16/2021. For the reasons stated on the record, the Court finds the defendant guilty as charged in the indictment, judgment of guilty entered. Case is referred to the Probation Office for a presentence investigation report. The Probation Office is directed to disclose its sentencing recommendation to the government and defense counsel. The presentence report is due by 4/6/2021. Sentencing memorandum and objections to the presentence report are due by 4/27/2021. Any responses are due by 5/4/2021. Sentencing is set for 5/11/2021 at 10:00 a.m. Counsel is to contact this Court's courtroom deputy well in advance of the sentencing, to advise as to whether the sentencing will be in person or by video. Defendant has until 3/9/2021 to file a motion for a new trial or for judgment of acquittal. The transcript is to be prepared under the Criminal Justice Act. Mailed notice.
