The Motion is a self-effectuating stipulation of dismissal pursuant to Rule 41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure, which states that a plaintiff may dismiss an action "without a court order by filing... a stipulation of dismissal signed by all parties who have appeared." Fed. R. Civ. P. 41(a)(1)(A)(ii). Accordingly, Plaintiff's claims were dismissed with prejudice upon the filing of the stipulation, and no court order is necessary.
