Then, on August 10, 2022, Plaintiffs filed a Second Amended Restated Complaint, asserting the same eight counts previously alleged but alleging an additional four chlorine gas releases, occurring on August 11, 2020, October 28, 2020, October 16, 2020, and January 27, 2022, and increasing the number of named plaintiffs to 141.
The elements of a personal injury claim are: (1) Failure on the part of the Defendant to exercise due care, (2) damages and/or injuries caused to Plaintiff, and (3) a direct casual relationship between 1 and 2.
Outcome: Remanded to the Circuit Court, Washington County, Alabama.
