Description: San Diego, California personal injury lawyer represented Plaintiffs, who sued Defendants on civil rights violation theories under 42 U.S.C. 1983 claiming that Lucky Phounsy, age 23, died as a direct result of the use of excessive force by Defendant San Diego Deputy Richard Fischer on April 13, 2015. Phounsy's family called 911 for help dealing with him during a mental health crisis.
Phounsy was repeatedly shocked with a stun gun and repeatedly struck and hogtied and strapped on a gurney. He died a few days later in a hospital.
Outcome: Settled for $12 million after a plaintiff's verdict for $85 million was set aside by the judge.
