The Fair Debt Collection Practices Act (FDCPA) is a federal law that protects consumers from unfair, deceptive, or abusive debt collection practices. The FDCPA applies to debt collectors who are attempting to collect a debt on behalf of a creditor.
The FDCPA prohibits debt collectors from engaging in a variety of practices, including:
Calling you at work if you have told them not to.
Calling you at unreasonable times, such as before 8:00 AM or after 9:00 PM.
Threatening you with arrest or violence.
Lying to you about the debt, such as telling you that you will be arrested if you don't pay.
Contacting your friends, family, or neighbors about the debt.
Taking any action that would damage your credit report.
If a debt collector violates the FDCPA, you may be able to sue them for damages. You may also be able to have the debt collector's actions declared unlawful.
