Description: Fargo, North Dakota personal injury lawyer represented the Plaintiff who sued the Defendant on an uninsured motorist insurance theory.

"North Dakota requires all registered and operated vehicles within the state to carry certain minimum insurance coverages, including uninsured motorist (UM) insurance. Here's an overview of North Dakota's UM insurance law:

Key provisions:

Mandatory coverage: Uninsured motorist coverage is mandatory for all car insurance policies in North Dakota. This means you must purchase UM coverage to legally register your vehicle.
Minimum limits: The minimum limit for UM coverage in North Dakota is equal to the bodily injury liability limits you choose for your policy. The state mandates a minimum liability coverage of $25,000 per person and $50,000 per accident. Therefore, your minimum UM coverage must also be $25,000 per person and $50,000 per accident.
Optional higher limits: While the minimum is $25,000/$50,000, you can choose higher UM coverage limits to provide greater protection in case of an accident with an uninsured driver.
Underinsured motorist coverage: North Dakota also requires insurance companies to offer underinsured motorist (UIM) coverage, which is equal to the limits of your UM coverage. UIM comes into play when a responsible driver's insurance coverage isn't enough to compensate you fully for your injuries.
Coverage triggers: UM coverage applies when you're injured in an accident caused by a driver who:
Doesn't have any auto insurance.
Has car insurance, but the coverage is insufficient to cover your damages.
Hits and runs.
Claims process: If you need to file a UM claim, you'll need to follow your insurance company's claims procedures. Typically, you'll need to provide evidence of the accident, your injuries, and the other driver's lack of insurance.

Important points:

You can reject UM coverage, but you must do so in writing with your insurance company.
UM coverage doesn't cover property damage to your vehicle.
Consider your financial needs and risk tolerance when choosing your UM coverage lim"
