This case was filed in the District Court, Rogers County, Case No. CJ-20-00158, and was removed to federal court by the Defendants.

On Mother's Day, Sunday, May 13, 2018, around 8:40 a.m., on Highway 42 near county road 4115 in Roberts County Dagoberto Chavez and Erick Chavez pulled the semi truck there were operating over on the right shoulder of the highway. They then attempted to make an illegal left turn causing a collision with Matthew Don Waterdown's vehicle severely injuring Plaintiffs.

The elements of a personal injury claim are: (1) Failure on the part of the Defendant to exercise due care, (2) damages and/or injuries caused to Plaintiff, and (3) a direct casual relationship between 1 and 2.
