Defendant's Attorney: Jonathan Clark

Description: Houston, Texas social security disability lawyer represented Plaintiff seeking review of the denial of his application for DIWC/DIWW benefits by HHS.

"DIWW stands for Disability Insurance With Work Restriction. If you are approved for DIWW benefits, you will be able to work part-time without losing your benefits. However, your earnings must be below a certain limit, or your benefits will be reduced.

To qualify for DIWW benefits, you must meet all of the same requirements as SSDI benefits, with one additional requirement:

You must be able to do some work, but not enough to earn the substantial gainful activity (SGA) amount.

The SGA amount is the amount of money you can earn each month and still be considered disabled for Social Security purposes. In 2023, the SGA amount for non-blind workers is $1,350 per month. The SGA amount for blind workers is $2,260 per month.

If you are approved for DIWW benefits, you will receive a monthly benefit amount that is based on your work history and earnings. The amount of your benefit will be reduced if your earnings exceed the SGA amount.

You can apply for DIWW benefits online, by phone, or in person at your local Social Security office. The application process can be complex, so it is a good idea to get help from an experienced disability attorney if you are considering applying for benefits.

Here are some additional things to know about DIWW:

You can apply for benefits even if you are still working. However, if you start working again and your earnings exceed certain limits, your benefits may be reduced or suspended.
You can receive DIWW benefits for as long as you are disabled and meet the work restriction requirement. However, if you become able to work full-time again, your benefits will stop.
You can also qualify for DIWW benefits if you are the spouse or child of a disabled worker.

For more information about DIWW, please visit the Social Security Administration website."
