Kiesten Hening, a former Virginia Tech women's soccer athlete, claimed that she was benched after she did not participate in a social justice demonstration sued Charles "Chugger" Adair, in his individual and official capacity as head coach of the womens soccer team at Virginia Polytechnic Institute and State University also known as Chugger Adair, for violating her First Amendment rights by retaliating against her after she refused to kneel in support of Black Lives Matter and other social-justice initiatives.

Outcome: Settled for $100,000 without an admission of fault by the Defendant. The case was set for trial on January 18, 2023.
