Description: Tulsa, Oklahoma criminal defense attorney represented Defendant, charged with robbery by force or fear in violation of 21 O.S. 792, which provides:

To constitute robbery, the force or fear must be employed either to obtain or retain possession of the property, or to prevent or overcome resistance to the taking. If employed merely as a means of escape, it does not constitute robbery.

The State Claimed that Kelsie Marie Higgins, age 27, and Demetreus Deon Cureington, age 21, held up at gun point an undercover police officer conducting a prostitution sting operation.

The defendants lured who they thought was just another customer who wanted to pay for sex to a motel in order to rob him.

Outcome: Being arrested for robbery is not proof of guilt.
