Terry Mabrey claimed that she was injured and/or damaged as a direct result of substandard medical care provided by the Defendants to her in 2019 during hip replacement surgery on her left hip at St. John Broken Arrow hospital performed by Dr. Scott Dunitz. She claimed that Dr. Dunitz failed to properly evaluate her prior to performing the surgery, failed to property the surgery, caused a femural fracture and failed to property monitor her condition post-operatively.
Defendants denied wrongdoing but admitted that approximately three months after surgery, an MRI revealed a "nondisplced periprosthetic fracture anteromedical subtrochanteric left femur.
Defendants also asserted that the maximum amount recoverable under 23 O.S. Sections 9.1, 15, and 61.2 and 12 O.S. Section 3009.1 and 577.4.
Outcome: Plaintiff dismissed without practice on November 13th, 2024.
The Court sanctioned the Plaintiff and ordered her to pay Dr. Dunitz #2,011 in attorney fees.
